Setbacks

Height Limits

Detached ADUs are limited to 16 feet in height. Properties located within half a mile of a major transit stop may qualify for up to 18 feet. Attached ADUs follow the height rules of the primary dwelling.

Owner Occupancy

As of 2020, California law eliminated the owner-occupancy requirement for ADUs through 2025. You do not need to live on the property to build or rent an ADU โ€” a significant change that opened up investment options.

Number of ADUs Allowed

Single-family lots may build one ADU plus one Junior ADU (JADU). Multi-family lots may build ADUs equal to 25% of existing units, with a minimum of two. Most single-family San Jose lots can add both an ADU and a JADU simultaneously.

Can I build an ADU if I have a mortgage on my property?
Yes. Having a mortgage does not prevent you from building an ADU. You should notify your lender and review your loan documents for any covenants, but conventional mortgages do not typically restrict ADU construction. Some homeowners finance ADU construction through a cash-out refinance or home equity line of credit.
Can HOAs block ADU construction in California?
No. California Civil Code Section 4751 explicitly prohibits HOAs from preventing ADU or Junior ADU construction on single-family lots. HOAs may regulate certain aspects of design and appearance to maintain community standards, but they cannot issue a blanket prohibition against building an ADU. If your HOA denies an ADU application, the denial is unenforceable under state law.
What is the difference between an ADU and a Junior ADU (JADU)?
A standard ADU is a fully independent dwelling unit with its own kitchen, bathroom, and entrance โ€” either attached to the main home or detached. A Junior ADU (JADU) is a smaller unit of up to 500 sq ft created within the existing footprint of the primary residence (commonly converting a bedroom or attached garage). San Jose lots may have one ADU plus one JADU simultaneously, effectively adding two rental units to a single-family property.
Do I need to owner-occupy the property to build an ADU?
California law eliminated the owner-occupancy requirement for ADUs from January 2020 through at least 2025.
