Can I Build an ADU on My San Jose Property?
The short answer for most San Jose homeowners is yes โ California state law gives nearly every residential property owner the right to build at least one Accessory Dwelling Unit (ADU). That said, specific eligibility depends on your zoning district, lot configuration, existing structures, and utility capacity. Here's what you need to know.
Key ADU Eligibility Requirements in San Jose
Zoning District
Properties zoned residential โ R-1, R-2, R-M, and most mixed-use zones โ are eligible. Industrial and commercial-only zones generally are not. You can look up your parcel's zoning at the City of San Jose's planning portal.
Lot Size
California state law removed minimum lot size requirements for ADUs as of 2020. There is no minimum acreage needed โ even small urban lots qualify. What matters is meeting setback requirements, not overall lot area.
Setbacks
Detached ADUs must be at least 4 feet from rear and side property lines. If you are converting an existing garage or accessory structure, no setback increase is required โ the existing footprint is grandfathered in.
Height Limits
Detached ADUs are limited to 16 feet in height. Properties located within half a mile of a major transit stop may qualify for up to 18 feet. Attached ADUs follow the height rules of the primary dwelling.
Owner Occupancy
As of 2020, California law eliminated the owner-occupancy requirement for ADUs through 2025. You do not need to live on the property to build or rent an ADU โ a significant change that opened up investment options.
Number of ADUs Allowed
Single-family lots may build one ADU plus one Junior ADU (JADU). Multi-family lots may build ADUs equal to 25% of existing units, with a minimum of two. Most single-family San Jose lots can add both an ADU and a JADU simultaneously.
